Vivid Tiles & Design Pty Ltd Terms & Conditions of Sale
TAX INVOICES: Vivid Tiles & Design Pty Ltd (ABN 75 322 707 439) issues tax invoices with prices and extensions exclusive of GST. The GST is added as a separate line item, immediately above the total amount due on the invoice.
QUOTATIONS: Quotations remain valid for one (1) month from quotation date, unless otherwise stated. Quotations will apply only to products and quantities as quoted. Significant variations to quantities or different products will be treated as separate enquiries and must be re-quoted.
TRADING TERMS: All charges on Vivid Tiles & Design tax invoices are due upon customer’s receipt of goods. Our delivery docket or memo, signed by the customer, customer’s employee or agent or by a carrier hired by the customer, will be deemed to be irrevocable confirmation of the receipt of the goods.
CANCELLATIONS AND REFUNDS: Please note a 30% non-refundable deposit must be paid prior to placing any order. We are not required to provide a refund or replacement if you change your mind. You can only choose a refund or exchange if an item is deemed to be faulty or defective. (Product would be required to be inspected first by the supplier purchased from). Item must be reported faulty or defective within 7 days to undertake this process.
All goods sold by Vivid Tiles & Design remain the property of Vivid Tiles & Design until the Vivid Tiles & Design tax invoice amount is paid in full.
DELIVERY: Delivery charges will be quoted depending on the required service. All deliveries will be craned off from truck to footpath only. Deliveries can be organised with a truck fitted with a forklift. Claims for incorrect supply, short supply or damaged tiles must be notified to us within 24 hours of receipt of tiles. We will not be held responsible for claims once goods are beyond our control. Vivid Tiles and Design will not be responsible for any delays in delivery which may result from any circumstances beyond its control. Any shipping dates provided by Vivid Tiles and Design are estimates only.
TILES: No claim for shade variation will be accepted by Vivid Tiles & Design after fixing of the tiles.
SUPPLY - TAKE CARE!
It is the customer’s responsibility to ensure that adequate stock is purchased to complete a job, as matching shades and stock cannot be guaranteed for subsequent orders. However, customers should also beware of over-ordering, as we do not accept back for credit, any returns.
SUITABILITY OF TILE: It is the responsibility of the architect, the builder, the tiler and the owner to ensure that the tiles selected are suitable for their intended application.
· Shade variations are inherent in all clay products.
· No responsibility can be accepted for crazing or shade variations.
· All tiles should be examined upon receipt.
· All tiles must be laid in accordance with recognised industry standards.
· The act of laying the material means the material is accepted for decor, shade, quality, type and size.
· It is the fixer’s responsibility to lay the material under control of the client or the client’s builder.
· No claim will be accepted once the material is laid.
FIXING OF THE PRODUCT CONSTITUTES ACCEPTANCE OF THE PRODUCT.
